Prohibition on Covered Technologies

The US Government issued Federal Acquisition Regulation (FAR) 52.204-24 on Aug 13, 2020 prohibiting certain telecommunications and video surveillance services or equipment, referred to as covered technology, from being used.  You can read the full text of the regulation here 

Covered foreign country means The People’s Republic of China.

Covered telecommunications equipment or services means

Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation, (or any subsidiary or affiliate of such entities);

For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities);

  • Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any of their affiliates);
  • Video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any of their affiliates);
  • Any telecommunications or video surveillance services provided by any of these entities using any such equipment; and
  • Any telecommunications or video surveillance equipment or services produced or provided by a company that the intelligence community reasonably believes is controlled or owned by the Chinese government.

The AIR Card and SEA Card participants are asked to respond regarding compliance of the requirement regarding covered technology.  To ensure compliance to this regulation, DLA-E has published a memorandum in relation to the new FAR. Please review this memorandum for your information and compliance measures. 

The way to provide this compliance for DLA-E is to provide your active DUNS number or CAGE code. If you are not certain of your DUNS number, that can be found on SAM.gov with your login credentials.  (Instructions on how to register on SAM.gov can be found here Please update your DUNS number or CAGE code at SAM.gov

DLA requires communication from the KHI merchant network to acknowledge receipt of the DLA memorandum and understanding of the Section 889 regulations as well as a record of compliance. Please fill out this form for KHI to accurately report the standing of our merchant network’s compliance.

Acknowledgement of this notice and a current DUNS number should be communicated to KHI by Oct 19, 2020.  

DLA-E can suspend merchant participation in the AIR Card and SEA Card programs if there is no response or non-compliance to this notice.
